Until the Terms are updated for EU shipping and bank transfer, the Polish text at <a href=\"https:\/\/altilion.pl\/regulamin\/\">altilion.pl\/regulamin<\/a> prevails in case of discrepancy.<\/em><\/p>\n<h2>\u00a7 1 Shop owner<\/h2>\n<p>1. The online shop altilion.pl, available at www.altilion.pl, is operated by:<\/p>\n<p>Auctionsb2b.com Micha\u0142 Parcha\u0144ski, Marcin Parcha\u0144ski s.c., Beskidzka 18, 43-426 D\u0119bowiec, NIP: 5482665573<\/p>\n<p>entered in the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for the economy.<\/p>\n<p>2. These Terms are addressed to Consumers and set out the rules and procedure for concluding a distance Sales Contract with the Consumer via the Shop.<\/p>\n<h2>\u00a7 2 Definitions<\/h2>\n<p>1. Consumer \u2013 a natural person concluding a contract with the Seller in the Shop, the subject of which is not directly related to that person\u2019s business or professional activity. Seller \u2013 a natural person conducting business under the business name.<\/p>\n<p>2. Customer \u2013 any person making purchases via the Shop.<\/p>\n<p>3. Entrepreneur \u2013 a natural person, a legal person or an organisational unit that is not a legal person to which a separate act grants legal capacity, conducting business in its own name and using the Shop.<\/p>\n<p>4. Shop \u2013 the online shop operated by the Seller at altilion.pl.<\/p>\n<p>5. Distance contract \u2013 a contract concluded with the Customer under an organised distance-contract system (within the Shop), without the simultaneous physical presence of the parties, using one or more means of distance communication up to and including the moment the contract is concluded.<\/p>\n<p>6. Terms \u2013 these Shop terms and conditions.<\/p>\n<p>7. Order \u2013 a declaration of the Customer\u2019s will submitted via the Order Form and aimed directly at concluding a Sales Contract for a Product or Products with the Seller.<\/p>\n<p>8. Account \u2013 the Customer\u2019s account in the Shop, which stores the data provided by the Customer and information about Orders placed in the Shop.<\/p>\n<p>9. Registration form \u2013 a form available in the Shop used to create an Account.<\/p>\n<p>10. Order form \u2013 an interactive form available in the Shop used to place an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Contract, including the method of delivery and payment.<\/p>\n<p>11. Cart \u2013 a part of the Shop software that shows the Products selected by the Customer for purchase and allows the Customer to set and change Order data, in particular Product quantities.<\/p>\n<p>12. Product \u2013 a movable item or service available in the Shop that is the subject of a Sales Contract between the Customer and the Seller.<\/p>\n<p>13. Sales Contract \u2013 a contract for the sale of a Product concluded or already concluded between the Customer and the Seller via the online Shop. Depending on the nature of the Product, a Sales Contract also means a contract for the provision of services or a contract for a specific work.<\/p>\n<h2>\u00a7 3 Contact with the Shop<\/h2>\n<p>1. Seller\u2019s telephone: +48 660 477 006<\/p>\n<p>4. The Customer may contact the Seller using the addresses and telephone numbers given in this section.<\/p>\n<p>5. The Customer may contact the Seller by phone or e-mail from Monday to Friday, 8:00\u201313:00.<\/p>\n<h2>\u00a7 4 Technical requirements<\/h2>\n<p>To use the Shop, including browsing the range and placing Orders for Products, the following are required:<\/p>\n<p>a. a device with Internet access and a web browser;<\/p>\n<p>b. an active e-mail account;<\/p>\n<p>c. cookies enabled.<\/p>\n<h2>\u00a7 5 General information<\/h2>\n<p>1. To the fullest extent permitted by law, the Seller is not liable for disruptions, including interruptions in the operation of the Shop, caused by force majeure, unlawful acts of third parties, or incompatibility of the Shop with the Customer\u2019s technical infrastructure.<\/p>\n<p>2. Browsing the Shop\u2019s range does not require creating an Account. The Customer may place Orders for Products either after creating an Account in accordance with \u00a7 6 or by providing the personal and address data needed to fulfil the Order without creating an Account.<\/p>\n<p>3. Prices in the Shop are given in Polish zloty and do not include VAT.<\/p>\n<p>4. The final amount payable by the Customer consists of the Product price and the delivery cost (including transport, delivery and postal charges), of which the Customer is informed on the Shop pages while placing the Order, including when expressing the will to be bound by the Sales Contract.<\/p>\n<p>5. Where the nature of the contract does not reasonably allow the final price to be calculated in advance, information on how the price will be calculated, and on charges for transport, delivery, postal services and other costs, will be given in the Shop in the Product description.<\/p>\n<h2>\u00a7 6 Creating an Account in the Shop<\/h2>\n<p>1. To create an Account in the Shop, the Registration form must be completed.<\/p>\n<p>2. Creating an Account in the Shop is free of charge and optional (guest checkout).<\/p>\n<p>3. Logging in to the Account is done by entering the login and password set in the Registration form.<\/p>\n<p>4. The Customer may at any time, without giving a reason and without any charge, delete the Account by sending an appropriate request to the Seller, in particular by e-mail or in writing to the addresses given in \u00a7 3.<\/p>\n<h2>\u00a7 7 Rules for placing an Order<\/h2>\n<p>To place an Order:<\/p>\n<p>1. log in to the Shop (optional);<\/p>\n<p>2. select the Product that is the subject of the Order and then click \u201cAdd to cart\u201d (or an equivalent);<\/p>\n<p>3. log in or place the Order without registration;<\/p>\n<p>4. if placing the Order without registration \u2014 complete the Order form by entering the recipient\u2019s details and the address to which the Product is to be delivered, choose the type of shipment (method of delivery), and enter invoice details if they differ from the recipient\u2019s details;<\/p>\n<p>5. click \u201cOrder and pay\u201d, confirm the Order if required (including via a link sent by e-mail), choose one of the available payment methods and, depending on the method, pay for the Order within the stated time, subject to \u00a7 8 point 3.<\/p>\n<h2>\u00a7 8 Offered delivery and payment methods and costs<\/h2>\n<p>1. The Customer may use the following methods of delivery or collection of the ordered Product:<\/p>\n<p>InPost<\/p>\n<p>DPD<\/p>\n<p>2. The Customer may use the following payment methods:<\/p>\n<p>BLIK, payment card, electronic transfer via the external payment system imoje, operated by ING Bank \u015al\u0105ski S.A. with its registered office in Katowice.<\/p>\n<p>3. Payment information:<\/p>\n<p>The Seller will make a refund using the same payment methods as those used by the Buyer.<\/p>\n<p>For online payments, the Order will be passed for fulfilment after the Customer\u2019s payment is credited.<\/p>\n<h2>\u00a7 9 Performance of the sales contract<\/h2>\n<p>1. A Sales Contract between the Customer and the Seller is concluded after the Customer places an Order via the Order form in the online Shop in accordance with \u00a7 7. The offer to conclude a contract made by the Customer (the Order) binds the Customer for 7 days.<\/p>\n<p>2. After the Order is placed, the Seller promptly confirms receipt and accepts the Order for fulfilment. Confirmation of receipt and acceptance for fulfilment is made by sending the Customer an e-mail to the address given when placing the Order, containing at least the Seller\u2019s statements that the Order has been received and accepted for fulfilment and confirmation that the Sales Contract has been concluded. Upon the Customer\u2019s receipt of that e-mail, the Sales Contract between the Customer and the Seller is concluded.<\/p>\n<p>3. If the Customer chooses:<\/p>\n<p>a. payment by bank transfer, the Customer must make the payment within 7 calendar days of the conclusion of the Sales Contract \u2014 otherwise the Order will be cancelled.<\/p>\n<p>4. If the Customer chose a delivery method other than personal collection, the Product will be sent by the Seller within the time stated in its description (subject to paragraph 5 of this section), in the manner chosen by the Customer when placing the Order.<\/p>\n<p>5. A. Where Products with different delivery times are ordered, the delivery time is the longest stated time.<\/p>\n<p>B. Where Products with different delivery times are ordered, the Customer may request delivery in parts or delivery of all Products after the entire Order has been assembled.<\/p>\n<p>6. The delivery period to the Customer starts as follows:<\/p>\n<p>a. where the Customer chose bank transfer, electronic payment or payment card \u2014 from the day the Seller\u2019s bank account is credited;<\/p>\n<p>b. where the Customer chose cash on delivery \u2014 from the day the Sales Contract is concluded.<\/p>\n<p>6. If the Customer chose personal collection of the Product, the Product will be ready for collection within the time stated in the Product description. The Customer will also be informed that the Product is ready by e-mail to the address given when placing the Order.<\/p>\n<p>7. Where Products with different ready-for-collection times are ordered, the ready-for-collection time is the longest stated time.<\/p>\n<p>8. Delivery of the Product takes place only within the territory of Poland.<\/p>\n<p>9. Product photos are illustrative and the goods may differ in reality.<\/p>\n<p>10. Order fulfilment time: up to 3 business days.<\/p>\n<h2>\u00a7 10 Right of withdrawal<\/h2>\n<p>1. The Consumer may withdraw from the Sales Contract within 14 days without giving any reason. Condition: the obligation must not be of a professional nature.<\/p>\n<p>2. The period specified in paragraph 1 starts from delivery of the Product to the Consumer or to a person indicated by the Consumer other than the carrier.<\/p>\n<p>3. Where the Contract covers several Products delivered separately, in batches or in parts, the period in paragraph 1 starts from delivery of the last item, batch or part.<\/p>\n<p>4. Where the Contract consists in regular delivery of Products for a specified time (subscription), the period in paragraph 1 starts from taking possession of the first item.<\/p>\n<p>5. The Consumer may withdraw from the Contract by submitting a statement of withdrawal to the Seller. To meet the deadline it is sufficient to send the statement before the deadline expires.<\/p>\n<p>6. The statement may be sent by traditional post or electronically to the Seller\u2019s e-mail address, or submitted on the Seller\u2019s website \u2014 the Seller\u2019s contact details are set out in \u00a7 3. The statement may also be made using the form at <a href=\"https:\/\/uokik.gov.pl\/download.php?id=1216\" target=\"_blank\" rel=\"noopener\">https:\/\/uokik.gov.pl\/download.php?id=1216<\/a>, which is an annex to the Act of 30 May 2014 on consumer rights, but this is not mandatory.<\/p>\n<p>7. In the event of withdrawal from the contract and return of the goods, the cost of sending the item back to the Seller is borne by the Buyer.<\/p>\n<h2>\u00a7 11 Complaints and warranty<\/h2>\n<p>1. The Sales Contract covers new Products.<\/p>\n<p>2. The Seller is obliged to deliver an item free from defects.<\/p>\n<p>3. If a defect is found in goods purchased from the Seller, the Customer has the right to complain on the basis of the warranty for defects under the Civil Code.<\/p>\n<p>4. The Seller will respond to the complaint promptly, no later than within 14 days; if the Seller does not do so within that time, the Customer\u2019s request is deemed accepted.<\/p>\n<p>5. Goods returned under the complaint procedure should be sent to the address given in \u00a7 3 of these Terms.<\/p>\n<p>6. If a warranty has been granted for the Product, information about it and its content will be included with the Product description in the Shop.<\/p>\n<p>7. An entrepreneur making a purchase of a non-professional nature may, from 1 January 2021, expect a warranty complaint to be considered within 14 days.<\/p>\n<p>8. Goods sold in the Shop are covered by a 2-year manufacturer\u2019s warranty.<\/p>\n<p>9. Complaint address: AuctionsB2B.com, ul. Liburnia 20, 43-400 Cieszyn.<\/p>\n<h2>\u00a7 12 Out-of-court complaint and claim procedures<\/h2>\n<p>1. Detailed information on the Consumer\u2019s ability to use out-of-court complaint and claim procedures and the rules for access to those procedures is available at the offices and websites of district (municipal) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, Voivodeship Inspectorates of Trade Inspection, and at the following websites of the Office of Competition and Consumer Protection:<\/p>\n<p><a href=\"http:\/\/www.uokik.gov.pl\/spory_konsumenckie.php\" target=\"_blank\" rel=\"noopener\">http:\/\/www.uokik.gov.pl\/spory_konsumenckie.php<\/a>;<\/p>\n<p><a href=\"http:\/\/www.uokik.gov.pl\/sprawy_indywidualne.php\" target=\"_blank\" rel=\"noopener\">http:\/\/www.uokik.gov.pl\/sprawy_indywidualne.php<\/a> and<\/p>\n<p><a href=\"http:\/\/www.uokik.gov.pl\/wazne_adresy.php\" target=\"_blank\" rel=\"noopener\">http:\/\/www.uokik.gov.pl\/wazne_adresy.php<\/a>.<\/p>\n<p>2. The Consumer has, for example, the following options for out-of-court complaint and claim procedures:<\/p>\n<p>a. The Consumer may apply to a permanent consumer arbitration court referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended) for resolution of a dispute arising from a Contract concluded with the Seller.<\/p>\n<p>b. The Consumer may apply to the voivodeship inspector of Trade Inspection, in accordance with Article 36 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), to initiate mediation for an amicable end to the dispute between the Consumer and the Seller.<\/p>\n<p>c. The Consumer may obtain free assistance in resolving a dispute with the Seller from the district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (including the Consumer Federation and the Association of Polish Consumers).<\/p>\n<h2>\u00a7 13 Personal data in the online Shop<\/h2>\n<p>1. The controller of Customers\u2019 personal data collected via the online Shop is the Seller.<\/p>\n<p>2. Customers\u2019 personal data collected by the controller via the online Shop are collected in order to perform the Sales Contract and, if the Customer consents, also for marketing purposes.<\/p>\n<p>3. Recipients of personal data of Shop Customers may be:<\/p>\n<p>a. Where the Customer uses postal or courier delivery in the Shop, the Controller discloses the collected personal data of the Customer to the selected carrier or intermediary performing shipments on the Controller\u2019s instructions.<\/p>\n<p>b. Where the Customer uses electronic payment or a payment card, the Controller discloses the collected personal data of the Customer to the selected entity handling those payments in the Shop.<\/p>\n<p>4. The Customer has the right to access and correct their data.<\/p>\n<p>5. Providing personal data is voluntary; however, failure to provide the personal data indicated in the Terms as necessary to conclude a Sales Contract means that the contract cannot be concluded.<\/p>\n<h2>\u00a7 14 Final provisions<\/h2>\n<p>1. Contracts concluded via the online Shop are concluded in the Polish language.<\/p>\n<p>2. The Seller reserves the right to amend the Terms for important reasons, namely: changes in the law, changes in payment and delivery methods \u2014 to the extent that those changes affect the performance of these Terms. The Seller will inform the Customer of each change at least 7 days in advance.<\/p>\n<p>3. In matters not regulated in these Terms, the generally applicable provisions of Polish law apply, in particular: the Civil Code; the Act on the provision of electronic services; the Act on consumer rights; and the Act on the protection of personal data.<\/p>\n<p>4. The Customer has the right to use out-of-court complaint and claim procedures. For this purpose the Customer may submit a complaint via the EU ODR platform at <a href=\"http:\/\/ec.europa.eu\/consumers\/odr\/\" target=\"_blank\" rel=\"noopener\">http:\/\/ec.europa.eu\/consumers\/odr\/<\/a>.<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>English translation of the current Polish Terms.
